• 6 of the Real Estate Settlement Procedures Act provides certain homeowners rights against certain mortgage-loan servicers. If there is an issue with loan servicing, § 6 of the Real Estate Settlement Procedures Act may provide recourse. Pursuant to § 6 of the RESPA, certain action however must proactive be taken.  Namely,

 

  • Qualified Written Request: The aggrieved homeowner must sent a qualified written request (“QWR”) to the loan servicer.
  • Failure to Comply: The loan servicer must fail to reply to the (“QWR”) within certain periods of time.
